Privacy Policy
The purpose of this Privacy Policy is to protect the fundamental rights of individuals whose personal information is collected through automated or non-automated processing.
Definitions :
- Nominative information is that which makes it possible to identify a specific or determinable natural person, i.e. one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more specific elements specific to his physical, physiological, mental, economic, cultural or social identity).
- The processing of nominative information is any operation or set of operations concerning such information, whatever the process used. The operations concerned relate to the collection, recording, organization, modification, conservation, extraction, consultation or destruction of information, as well as to the exploitation, interconnection or reconciliation, communication of information by transmission, dissemination or any other form of provision.
- The data controller is the natural or legal person, private or public, the public authority, the service or any other body which determines, alone or jointly with others, the purpose and means of the processing and which decides on its implementation.
- The recipient of the processing, if any, is the natural or legal person, whether governed by private or public law, the public authority, department or any other body that receives the data communications, other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorised to process the data.
In this case, the personal information collected and stored by Icon Property – Real Estate is only communicated when strictly necessary and, where applicable, only to professionals who are subject to confidentiality obligations at least equivalent to those to which Icon Property – Real Estate is subject to.
- The person concerned by the processing of personal information is the person to whom the information being processed relates.

- Icon Property – Real Estate processes personal information about its clients in order to meet its legal obligations, in a secure manner and under the responsibility of its manager, Mr Eduardo CHACÓN.
- The personal information processed, in this context, are those relating to the civil status of persons concerned by the treatment and the origin of funds that will be involved, if any, in an envisaged transaction.
Under no circumstances may the personal information collected by Icon Property – Real Estate concern political, racial, ethnic, religious, philosophical, trade union opinions or affiliations. Also, no personal information relating to health, genetics, sex life, morals or social measures will be collected.
- Given that the personal information processed is that which Icon Property – Real Estate is legally obliged to collect, failure to communicate said information will prevent the completion of any transaction.
- Icon Property – Real Estate undertakes to keep information enabling the identification of persons concerned by the processing of their personal data for a period not exceeding 5 years.
- Any person (natural or legal) concerned by the processing of data may, at any time, access the information concerning him or her and obtain that it be modified, rectified, completed, clarified, updated or deleted when it is found to be inaccurate, incomplete, ambiguous or out of date.
If personal information whose collection, recording, communication or storage is prohibited has been collected, the person (natural or legal) concerned by the processing of this data may demand that it be deleted immediately.
Icon Property – Real Estate SARL undertakes to take all reasonable steps to ensure that inaccurate or incomplete data is deleted or corrected as soon as possible.
Where applicable, and if the information concerned has been communicated to third parties, Icon Property – Real Estate SARL undertakes to notify the said third parties of its modification or deletion.
- Furthermore, Icon Property – Real Estate SARL undertakes to take all appropriate measures to :
- to complete or modify automatically any incomplete or erroneous information as soon as it is made aware of its inaccuracy;
- to automatically delete any information that has been obtained by fraudulent, unfair or illegal means
- delete the nominative form of the information at the end of the 5-year retention period.
In any case, the personal information collected will not be used on behalf of third parties, nor will it be communicated to third parties for commercial prospecting purposes.
- SARL Icon Property – Real Estate undertakes to inform any person requesting it, whether or not personal information concerning him or her is processed by the agency.
Where applicable, any person to whom the personal information being processed relates to, may at any time request clarification as to the purpose of the data processing, the categories of information to which it relates to, and the categories of recipients to whom the information collected may be communicated.
SARL Icon Property undertakes to communicate to the applicant the information stored, in a written form, not coded and in accordance with the content of the records.
